“Health Education” in Polish Schools Is Not Mandatory – Here’s Why
🔍 What’s going on in Poland?
In September 2025, public schools in Poland introduced a new subject: “Health Education.”
Media promoted it as a positive step, but many parents raised concerns – not just about the content, but the legality of the subject itself.
👉 It turns out the whole process violated Polish constitutional law.
⚖️ Why is “Health Education” considered illegal?
According to Article 151 of the Polish Constitution, anyone appointed as a minister must take an official oath before the President, using exact wording specified by law.
🟥 Barbara Nowacka, the person supposed to be Minister of Education, never took the proper oath.
As a result:
- ❌ She did not become a legal government minister.
- ❌ She had no right to issue ministerial regulations.
- ❌ The introduction of “Health Education” has no legal basis.
🚫 The subject is not legally binding, and schools are not obligated to follow such unlawful instructions.
🏫 What does this mean for schools and families?
If a school claims:
- “We must teach this subject.”
- “The ministry required it.”
- “This is official policy.”
✅ You can confidently respond: there is no legal foundation for this.
- There is no valid regulation.
- The person who signed the documents was not authorized.
- Schools are not legally required to run these lessons.
💷 What about the salary she received?
Barbara Nowacka, who did not legally become a minister, collected a minister’s salary.
This is considered:
❌ “Undue benefit” – a payment to someone not entitled to it.
💼 Under Polish and EU law:
- This money must be returned to the state.
- The situation may lead to official investigations for financial misconduct.
👪 What can parents do?
In Poland, as in most democratic countries:
🟢 Parents have the constitutional right to decide how their children are educated.
You can:
- ✍️ Submit a simple statement refusing your child’s participation in “Health Education.”
- 📩 Deliver it to the school office or send by email.
- ✅ Your decision must be respected by the school.
